Class Action Lawsuit Challenges Disney’s New Disability Access Policies

Recent changes to Disney’s Disability Access Service (DAS) have ignited controversy, with many disabled guests voicing concerns that the new eligibility criteria unfairly exclude those with physical disabilities. While Disney has justified the changes as a necessary step to curb widespread abuse of the system, critics argue that the modifications disproportionately impact guests with legitimate disabilities. Now, a class action lawsuit has been filed against Walt Disney Parks and Resorts and Inspire Health Alliance in California, alleging that the new DAS policies violate disability rights laws.

Class Action Lawsuit Filed Against Disney Over Changes to Theme Park Disability Access Service 2

The lawsuit, Malone v. Disney, was filed by Trisha Malone, a disabled guest who claims she was denied access to DAS despite her medical condition preventing her from waiting in traditional attraction queues. Represented by McCune Law Group, the lawsuit argues that Disney’s revised policies violate the Unruh Civil Rights Act, which prohibits discrimination based on disability, as well as privacy laws related to the handling of medical information. The complaint further alleges that Disney:

  • Unlawfully restricted DAS eligibility to guests with developmental disabilities while excluding those with physical impairments.
  • Required guests to disclose sensitive medical information in public settings, violating their privacy rights.
  • Provided inadequate alternative accommodations that fail to offer equal access, creating logistical and emotional burdens.
  • Coerced guests into signing unfair agreements, including a class action waiver designed to discourage legal challenges.

Adding an interesting twist, one of the attorneys bringing the case was a former moderator of the Facebook group Disney DAS Defenders, a community dedicated to advocating for disabled guests. In a post announcing their resignation from the group, the attorney confirmed their law firm’s involvement in the lawsuit and encouraged affected individuals to stay informed and share their experiences.

While Disney has yet to publicly respond to the lawsuit, the company has maintained that its DAS program is intended for guests who cannot tolerate traditional queues due to developmental disabilities and that other accommodations, such as return times or ride re-entry, are available for those who do not qualify. However, many disabled guests argue that these alternatives are impractical and fail to provide an equitable theme park experience.

This lawsuit could have major implications for Disney’s approach to accessibility and its obligations under disability rights laws. With strong opinions on both sides, the outcome will likely set a precedent for how theme parks nationwide handle accommodations for guests with disabilities.

What do you think about Disney’s changes to the DAS program? Let us know in the comments.

Disney Responds to Rising Prices: Are Discounts Enough to Keep Families Coming Back?

A trip to Walt Disney World has long been a dream vacation for many families, but in recent years, rising costs have made that dream harder to attain. A recent Wall Street Journal report highlighted the growing expense of visiting Disney’s theme parks, noting that ticket prices, hotel rates, and the cost of add-ons like Lightning Lane have outpaced inflation. Some guests now find the price of a Disney vacation too steep, leading to questions about whether the company is at risk of pricing out its core audience.

Disney World Responds to High Pricing Following Report on Rising Theme Park Costs 1

Disney, however, maintains that its parks remain accessible. In response to concerns over affordability, Josh D’Amaro, Chairman of Disney Experiences, reiterated the company’s commitment to offering a variety of pricing options. “We intentionally offer a wide variety of ticket, hotel, and dining options to welcome as many families as possible, whatever their budget,” he said. But while Disney has introduced limited-time promotions, such as discounted Florida resident tickets and special hotel offers, the company’s response suggests that there are no plans to reduce overall pricing beyond these targeted deals.

Disney’s Cost Structure and the Luxury Theme Park Market

Disney World Responds to High Pricing Following Report on Rising Theme Park Costs 2

Unlike many competitors, Disney operates within the luxury sector of the theme park industry, offering premium experiences at premium prices. The company has increasingly structured its pricing strategy around demand in recent years, increasing costs as long as ticket sales and park attendance remain strong. Even as some guests express frustration over rising prices, Disney’s parks division continues to be one of its most profitable segments, generating billions in revenue.

While attendance growth has slowed compared to post-pandemic surges, Disney remains a dominant force in the theme park business. The company has made it clear that while it is willing to adjust pricing through promotions, it does not intend to roll back the overall cost of a Disney vacation.

Current Discounts and Promotions

Disney World Responds to High Pricing Following Report on Rising Theme Park Costs 4

In an effort to provide savings opportunities, Disney has launched several promotional offers, including:

  • Florida Resident Discover Disney Ticket: Four days of park access for $60 per day (plus tax).
  • Disneyland Kids’ Special Ticket: Tickets for children aged 3-9 for as low as $50 per child (valid Jan. 7 – March 20, 2025).
  • Southern California Resident Deal: Three-day, one-park-per-day tickets starting at $67 per day ($199 total).
  • Disney Resort Hotel Discounts: Savings of up to 30% on select hotel stays for summer 2025.
  • Complimentary Water Park Admission: Beginning in January 2025, guests staying at Disney-owned resorts will receive free water park access on their check-in day.

These deals provide some relief for guests looking for ways to save, but they also reinforce Disney’s current pricing structure rather than signaling any fundamental change in its approach.

Is Disney Still Worth the Price?

For many families, Disney parks remain the gold standard in themed entertainment, offering immersive attractions, world-class dining, and experiences that can’t be found elsewhere. A recent survey commissioned by Disney found that most guests who visited felt the experience was worth the expense, and the company continues to invest in new attractions and experiences to maintain its appeal.

However, for those accustomed to lower prices or complimentary perks like the now-retired Magical Express and free FastPass, the cost of a Disney vacation today may feel like a significant barrier. As long as demand for Disney remains strong, the company is unlikely to reduce overall costs—but for families willing to plan strategically and take advantage of promotions, there are still ways to experience the magic without breaking the bank.

Ultimately, Disney’s pricing strategy reflects its position as a premium theme park destination. While some guests may opt for alternative vacations, Disney’s parks will continue to operate at current price levels as long as the market supports them. Whether these rising costs will eventually impact long-term attendance remains to be seen—but for now, Disney is betting that the magic is still worth the price.

What do you think? Will Disney’s promotions be enough to keep families coming back, or has the price of a Disney vacation climbed too high? Let us know your thoughts! ✨🏰

Disneyland Return Visits Show Significant Decrease

Disneyland Sees Sharp Decline in Repeat Visitors

High prices at Disneyland and Disney World are causing a growing number of Disney fans to rethink return trips, according to a Wall Street Journal report. Despite discounts and promotions, the cost of tickets and in-park extras has made Disney vacations increasingly unaffordable for many Americans, leading to a decline in repeat visits. The report suggests Disneyland, in particular, has become one of the world’s most expensive destinations, prompting many fans to reconsider their future plans.

“Internal discussions over whether Disney parks may be losing their grip on the hearts and wallets of families with young kids have become more frequent,” according to the Wall Street Journal.

Disney’s own surveys reveal a sharp decline in planned return trips to its U.S. theme parks, the Wall Street Journal reports. Starting in 2023, fewer visitors expressed intentions to return to Walt Disney World and Disneyland, suggesting a cooling enthusiasm among even the most devoted Disney fans.

Disney is actively working to boost return visit intentions, using discounts and promotions to try and improve the concerning survey results, according to the Wall Street Journal.

DCA

Despite the declining return visits, Disney maintains that most guest surveys still rate Walt Disney World as a good to great value for the price, according to the Wall Street Journal.

“The number-one thing we hear from the millions of guests who visit our parks each year is how much a Disney vacation means to them and we intentionally offer a wide variety of ticket, hotel and dining options to welcome as many families as possible whatever their budget,” Disney Parks chairman Josh D’Amaro said in statement released by the company. “We also know that in inflationary times it’s especially important to give families ways to save on their visits.”

DL night

The Wall Street Journal reports that Disney theme park attendance growth has slowed in recent years. Disney CFO Hugh Johnson has described this slowdown as a “hiccup.” To entice visitors, Disneyland is currently offering a $50 kids ticket deal through March 20th and $199 3-day passes for Southern California residents through May 15th. Notably, Disneyland has held its lowest-priced one-day, one-park ticket at $104 since 2019.

Have Disney’s price increases kept you from planning return visits?

Manatee Exhibit Reopens in EPCOT as Disney Shifting to Short-Term Rehabilitation

EPCOT’s Manatee Exhibit Reopens with Short-Term Rehab Focus

Two new manatees have arrived at EPCOT’s The Seas with Nemo & Friends! The manatee exhibit has reopened, marking a new chapter in Disney’s commitment to manatee conservation. This reopening follows the temporary closure after Lil Joe and Inigo’s relocation.

manatees

Disney’s long-standing commitment to manatee care has evolved. For decades, their marine care program provided long-term housing and rehabilitation. Now, in partnership with the Manatee Rescue & Rehabilitation Partnership (MRP) and the U.S. Fish and Wildlife Service (FWS), Disney has transitioned to short-term, critical rehabilitation. This new focus allows them to provide crucial temporary care for manatees recovering from life-threatening situations before their release back into the wild.

exhibit

“As strandings increase, critical care facilities are becoming overwhelmed, so by shifting our focus, we open up space at The Seas for more of those urgent cases,” said Dr. Jen, a veterinarian at Walt Disney World. “This helps relieve pressure on overcrowded facilities, supports the MRP’s efforts, and boosts our contribution to manatee conservation.”

Manatees_at_EPCOT-6

Cider and Mino are the first manatees to arrive at EPCOT under the exhibit’s new rehabilitation model. Their stay is expected to last six to nine months, with the goal of releasing them back into the wild during the food-rich winter months.

Disney’s Animal Health Director, Dr. Geoff, explained the program’s focus:
“Our role begins once critical and acute care has been completed. At that point, we may receive a stable manatee that simply needs some time to grow or gain weight before being released. The hope is that no manatee remains with us for too long — our goal is to ensure they are healthy and strong enough for a successful release back into the wild.”

epcot

The Seas with Nemo & Friends has undergone significant improvements to provide the best possible care for recovering manatees. A new medical lift floor allows veterinarians to perform health checks easily, while access to Disney’s on-site veterinary hospital and its CT scanner enable advanced diagnostics. Disney’s Water Sciences team also ensures optimal water quality with a state-of-the-art filtration system.

Manatees_at_EPCOT-7

The transition to short-term critical care for manatees at EPCOT is part of a larger effort to protect Florida’s endangered manatee population. The need is critical: between 2020 and 2022, over 2,000 manatees died due to habitat loss, food scarcity, and environmental threats like red tide. While 2024 has brought some improvement, manatee calf mortality, especially in areas like Brevard County’s Indian River Lagoon, remains a concern.

“In rehabilitation, success isn’t just about releasing animals — it’s about seeing them thrive once they’re back in the wild,” Dr. Geoff said. “That’s what I love about the manatee program: they track the animals long-term. With manatees, we get to see months later that they’re still out there thriving. That’s the true measure of success for us.”

Hurts then took center stage in a special championship parade through Magic Kingdom, waving to fans as they cheered on the Eagles’ big win.

During our time with him, Jalen reflected on the hard work and dedication it takes to win on the biggest stage in football. “You work 364 days a year for one moment, and that’s to hold that trophy in the air” he shared, acknowledging that while he’s enjoying the moment, there’s no such thing as a true “offseason” for a champion. He also noted that Tron is his favorite ride at Disney, adding in the disclaimer that it is the only attraction he had ridden at Walt Disney World up to that point.
