Summary Judgement For Disney Denied In Case Against Characters For Hire

A New York federal judge has refused a summary judgement in favor of Disney Enterprises, INC in it’s ongoing case against Characters For Hire. Characters For Hire is a company that provides “premium characters” for happenings ranging from birthday parties to corporate events. On Thursday, U.S. District Court Judge George Daniels acknowledged that Characters For Hire has similar characters to those owned by Disney but does not see where the they would be confused for actual Disney owned characters.

While Characters For Hire specifically states on their website “We are the largest provider of generic costumed characters (WE DO NOT OFFER TRADEMARKED CHARACTERS)”, they have personalities labeled as “The Princess” and “Big Hairy Guy”, as well as others that have a striking resemblance to Princess Leia and Chewbacca from Star Wars. There have also been instances of Frozen and Avengers themed parties advertised on their website. Characters For Hire even amended their contracts a few years ago to include the following:

“Client understands that costumed characters are generic/inspired and are NOT affiliated, licensed or associated with any copyright or trademark. It is not our intention to violate any copyright laws. The characters that we offer are NOT name brand copyrighted characters, and Character for Hire, LLC costumed characters are named of our own creation. Any resemblances to nationally known copyrighted characters is strictly coincidental. We DO NOT offer nor do we present any licensed and/or copyrighted characters.”

Disney (the Plaintiff) filed claims against Characters For Hire “for trademark infringement, copyright infringement, and unfair competition and false designation of origin” as well as “trademark dilution”. The judges ruling is as follows:

“Defendants’ motion for summary judgment, (ECF No. 66), dismissing Plaintiffs’ claims for (i) trademark infringement, (ii) unfair competition, and (iii) false designation of origin is GRANTED. However, Defendants’ motion for summary judgment dismissing Plaintiffs’ claims for (i) trademark dilution, and (ii) copyright infringement is DENIED. Plaintiffs’ motion for partial summary judgment on its claims of (i) trademark infringement, (ii) copyright infringement, and (iii) trademark dilution, (ECF No. 59), is similarly DENIED.”

“Based on the current record, this Court cannot conclude that Defendants have infringed Plaintiffs’ copyrighted characters because Plaintiffs do not point to any admissible evidence demonstrating that Defendants have engaged in the alleged infringing conduct,” writes the judge. “For instance, Plaintiffs rely on various poor quality screenshots of CFH’s website and other social media sites, including screenshots of older versions of the websites preserved by the Internet Archive… The screenshots and videos, however, have not been properly authenticated…”

Disney and Characters For Hire will be back in court at a later date if a settlement is not reached.

No More FastPass+ Transfers On MDE Website

The My Disney Experience App (MDE) has been recently updated to create a more user-friendly experience and fix some of the current “bugs” in the system. With these recent changes, there have been updates that some may not be as happy with. In the past, if you had a group that wished to cancel a FastPass+ for one or more of the party, you simply transfer it to another guest in your party. With the new update, you are no longer able to do this. Instead, you must cancel the FastPass+ altogether for the guest not riding and hope another guest in your party is able to quickly pick it up after it is dropped. Well, it now looks like those changes have crossed over to the MDE website as well.

No More FastPass+ Transfers On MDE Website

The ‘Update Party” button is no longer there. All you can do now is add guests or cancel altogether. This update is supposed to be a way to prevent fraud within the Fastpass+ system.

Disney has continually updated and modified their website and mobile features to make your visit to the parks, Disney Springs, and resorts as smooth as possible. MDE is a great tool to find a character spot in the park, check wait times, locate dining, and so much more.

In addition to all the options on MDE, you are now able to use Mobile Food Ordering to make mealtime a breeze. Who likes waiting in line after a sweltering day in the park for your food? Now you can order ahead and have it ready to pick up by the time you reach your Quick Service location.

New Overpass Opening Means New Traffic Patterns Around the Magic Kingdom

After several months of construction, one of two new World Drive overpasses near the Magic Kingdom is now open. WDWMagic.com is reporting that the completion of the new northbound overpass means a different traffic pattern for guests visiting one of the Magic Kingdom Resort Area Hotels.

Guests visiting Disney’s Contemporary Resort and heading north on World Drive will now use the left lane to access the new northbound overpass. Guests heading to Disney’s Fort Wilderness Resort will keep still exit World Drive from the right lane to Vista Boulevard.

At this time there are no changes for guests who are planning to visit the Magic Kingdom. Guests can proceed on World Drive to the auto plaza like before.

No timetable has been confirmed but the southbound World Drive overpass should also be opening shortly. Keep following along with us here at Chip & Co for all the latest on the traffic patterns around Walt Disney World and the Magic Kingdom.

It may be August but SeaWorld is already planning out their Christmas Season! Just announced, beloved Christmas characters Rudolph the Red-Nosed Reindeer and friends, including Clarice, Bumble, the Abominable Snow Monster and Yukon Cornelius, and Rudolph themed attractions will continue to be featured as part of the Christmas Celebration™ events at SeaWorld parks in Orlando, Fla., San Antonio and San Diego; Christmas Town™ at Busch Gardens parks in Tampa, Fla. and Williamsburg, Va. and A Very Furry Christmas at Sesame Place in Langhorne, Pa.

The five-year contract extension was announced yesterday by SeaWorld Parks & Entertainment and Character Arts, LLC, the exclusive licensor of Rudolph the Red-Nosed Reindeer and all of the characters from the 1964-television special. The extension ensures that Rudolph & Friends will continue to add holiday fun to the theme parks’ already popular Christmas events through January 31, 2024.

Walk-around characters, photo areas, dining opportunities, and games are just some of the ways the world’s most famous reindeer will be featured at the theme parks.

“We are thrilled that Rudolph will continue to be part of the wonderful Christmas experiences at SeaWorld, Busch Gardens, and Sesame Place,” said Jonathan Flom, founder, Character Arts. “These characters have already been so well-received by park guests, and we are looking forward to continuing sharing the holiday fun.”

Scott Frazier Watson Identified as Disney Imagineer Killed in Plane Crash

A Disney Imagineer was killed in a plane crash on Sunday. 55 year old Scott Frazier Watson was piloting a small plane when it crashed into a field along 5 Freeway in Sylmar – a neighborhood in the San Fernando Valley region of Los Angeles, California.

Watson was pronounced dead at the scene. It has been reported that motorists driving on the 5 Freeway pulled off to the side of the road and ran down to try and help the pilot before emergency services arrived. The crash was visible from the freeway, slowing traffic to a crawl.

The father of three, he had has his pilot license for 15 to 20 years according to his daughter.  He was reported flying home to the Van Nuys Airport after a weekend away.  Known by his family as a “computer genius,” Watson worked his way up the ranks at Disney to the role of Head of Technology.  According to his family he was responsible for programming rides at Disney parks around the world.

Disney Imagineering President, Bob Weis released a statement saying “The Walt Disney Company is stunned and saddened by the loss of our long-time friend and colleague, Scott Watson.  Those of us who worked with Scott during his nearly 30-year career at Disney knew him as a humble genius who made making magic look easy. Our hearts are with his family during this difficult time.”

While Watson did make a mayday call before his plane went down, the cause of the crash is unknown.

FAA and National Transportation Safety Board officials were on scene Monday looking through the plane’s wreckage.
