Will Johnny Depp Have to Pay Punitive Damages?

Johnny Depp has long been a Disney favorite for his roles in the “Pirates of the Caribbean” and “Alice in Wonderland” movies. Most Disney fans are also looking forward to Disney’s movie, “The Night Stalker” due out in the future and starring Depp. But unfortunately, the news today is not about Disney movies and Johnny Depp but a lawsuit involving Depp’s security team and ultimately Johnny Depp himself.

Judge Michael Johnson in a new ruling is allowing the woman suing Johnny Dep and Live Nation to pursue punitive damages against the actor. The judge had previously denied punitive damages to Robin Eckert, an assistant clinical professor at University of California Irvine School of Medicine, though allowing her to amend her lawsuit, which she did. The judge had also previously ruled that Eckert would have to identify herself and dismissed several causes of action, including negligent infliction of emotional distress and employment claims related to the hiring of security guards in question.

What is all the commotion about? Well, Eckert anonymously sued Depp and Live Nation back in April, alleging that she was involved in an altercation at an Iggy and the Stooges concert the prior December at the Hollywood Palladium and she had been injured. In her complaint, she claims she was dragged across the VIP section and her shoes came off and clothes were disheveled. She also claims she was handcuffed and dragged through the venue, “exposing her buttocks to the other Hollywood Palladium theater patrons.”

The anonymous part was a portion of why the judge required her to amend her lawsuit and since she has, Judge Johnson has ruled that she has sufficient facts to pursue punitive damages in this case.

Johnson goes onto say that Depp’s attorneys argue that security only intended to restrain her and keep her separated from Depp so as to protect him from a “potential out-of-control fan,” but at this stage of the case, those alleged facts can’t be considered.

If the case gets to trial, Eckert will only be able to recover punitive damages in her assault and battery case if she can prove intentional misconduct or gross negligence. Johnny Depp’s attorneys have responded:

“The ruling only relates to a motion to strike the allegation,” says Marty Singer, Depp’s attorney. “There was no finding that she is entitled to punitive damages. This is a ridiculous suit against our client. After we prevail, we intend to pursue claims against the attorneys and the plaintiff for malicious prosecution.”

Goofy invades The 2012 Osborne Family Spectacle of Dancing Lights

Since the show’s debut in 1995, it has never failed to impress Disney fans. Over the years, the display has grown to more than 5 million lights and been enhanced with everything from a complete conversion to energy-efficient LEDs to the addition of images and music from Disney’s “Prep & Landing” television specials. It’s all so tinsel!

The team behind The Osborne Family Spectacle of Dancing Lights keeps looking for new ways to “plus” the show. This year, Santa Goofy joins the fun, making nightly appearances on the Streets of America. You’ll be able to meet him in Goofy’s Winter Wonderland, a special area set up right in Tri-City Square.

Also new is the addition of an eighth song for the dancing lights. Joining returning favorites like “Feliz Navidad” by Jose Feliciano and Barbara Streisand’s version of “Jingle Bells” will be a special arrangement of the classic “Winter Wonderland” by Creative Entertainment Music Director Dan Stamper.

“As we talked about adding a new piece, we wanted to add something lyric and flowing,” said Dan. “To me, the title ‘Winter Wonderland’ meant a time of transformation from hustle and bustle to an elegant beauty. In my mind were images of billowing marshmallow landscapes; where in the city, even the starkest, dark industrial buildings become a thing of beauty with snowcaps and gleaming icicles. The piece grows to a crescendo and then slowly fades as families gather together in their homes to escape the chill.”

Open Letter to Disney by the Food Police

 

On Monday, an open letter was sent to Disney and addressed to Robert Iger, Walt Disney Co. CEO asking them to stop placing or allowing Disney characters on holiday treats from the Center for Science in the Public Interest (“CSPI”). This coming two days prior to one of the biggest candy holidays of the year, Halloween, the letter began by commending Disney on their efforts to help with responsible marketing to children by changing some former policies.

“Disney took a big step forward this year by deciding that it will no longer accept advertisements for many unhealthy foods on children’s television, radio, and online programming, and will update its nutrition standards for licensed characters and sponsorships on the Disney Channel. Your work has made Disney an industry leader in responsible food marketing to children and we look forward to the company’s continued progress in this area…” The Letter from the Center of Science in the Public Interest stated.

What the CSPI is asking is for Disney to take an even bigger step in their campaign for responsible marketing to children. Knowing that kids are always going to want Disney themed birthday cakes, but they are asking for the promotion from everyday marketing campaigns to stop. Listed as “offenders” to this just from the Halloween marketing are:

  • Cinderella – Princess Halloween Shape Sugar Cookies manufactured by Pillsbury;
  • Halloween – Mickey Mouse Mallow Pops manufactured by Flix Candy; and
  • Disney Candy Mix manufactured by Frankford Candy featuring characters from Toy Story, Cinderella, Cars, and Peter Pan.

In conclusion, the letter asks Disney to limit their licensing of characters to companies that are in contrast to what the CSPI considers “responsible marketing to children.”

Disney has responded to the LA Times inquiry with this response:

“Disney inspires kids and families to lead healthier lifestyles through comprehensive nutrition guidelines and food advertising standards that were a first for a major media company. For those special occasions where families enjoy celebrating with our characters, we reserve a mere 15% of our overall licensed food business for specialized items like birthday cakes, holiday and Halloween treats.”

Things you can only get at Walt Disney World…

It’s not always easy being an adult Walt Disney World lover. When I tell people I am headed to WDW on my next vacation, I get that weird look, that one that says “really? What a weirdo”…usually it only lasts a second, and they say something like “Oh, that’s nice” when what they really mean is “that’s for kids…I wouldn’t want to go there”. In these situations, I usually try to be a Disney cheerleader, rallying for Team WDW, and i have come up with this list of things that are so unique, that you can only get them at Walt Disney World:

The Service: The employees of WDW (they call them Cast Members) provide the highest level of service I have ever experienced. They are friendly, polite, helpful, and most of all, they actually seem to really like their jobs. They will bend over backwards to make sure you have an amazing time, and that is truly special, and something you don’t see much of these days.

The Accommodations: Disney has many different choices of places to stay, all with their own theme. From the Polynesian Resort that’s like living in a luau, to the Port Orleans Resort where they serve up gumbo and beignets with a true Louisiana flair, to the Boardwalk Resort-where they have a real wooden boardwalk reminiscent of Old Atlantic City (this one is my personal favorite, and is breathtaking at night!)

So many people travel to Walt Disney World and never experience any of the fun Fort Wilderness has to offer.  Since 1971, the Campsites at Fort Wilderness Resort have been accommodating guests on over 700 acres of wooded trails.  This camping resort offers campsites for tents, pop ups and RVs and has cabins for those who don’t want to “rough it!”  But, there are so many other things to do here than “camp!”  Below, you will find a listing of the restaurant options, things to do around the resort and even seasonal activities.  If you are needing to plan a day off during your WDW vacation, I highly suggest taking a bus or boat to Fort Wilderness and spending the day having fun with your family!

Restaurants:

  • Trail’s End Restaurant– Enjoy a buffet for breakfast or dinner and an a la carte lunch.  This restaurant features pioneer style food (fried chicken, ribs, roasted meats, veggies, salad bar, soup, cobbler, and ice cream) in a rustic log cabin style decor.
  • Hoop Dee Doo Musical Revue– This is a dinner show featuring western dancing, singing, skits and vaudeville comedy in Pioneer Hall.  You can also enjoy an all you can eat feast of American favorites: friend chicken, ribs, vegetables. baked beans, corn bread and strawberry shortcake.  Reservations are suggested and pre payment is required.
  • Mickey’s Backyard BBQ– Enjoy an outdoor picnic with Mickey Mouse and friends in the covered open air Pavilion at Fort Wilderness.  Participate in line dancing, singing to a country-western band and playing kid friendly games.  Enjoy a buffet of BBQ ribs, smoked chicken, hamburgers, hotdogs, corn on the cob, watermelon and more.  Due to inclement weather, this may be cancelled.
  • Crockett’s Tavern– This is an outpost lounge serving pizza, nachos and more from a full service bar.

Happy, happy day there guys and gals, Anonymouse here. I am starting to count down the days to my next Disney trip and whenever that happens I start wanting to know what is coming and when! All the news, gossip and rumors that can be found, heard and talked of that is exciting to all of the Disney fans out there can be found right here!

First up today is Carsland in Walt Disney World. Who wants to hear about that??? ME! Yes, I know some Disneyland folks want to keep it for themselves but rumors are abounding that this is not going to be the case. Disney is making some announcements to the media and a special one to Anonymouse on December 7th and word on Main Street, USA is that the Carsland in WDW announcement is one of pieces of information to be heard.

Second we have a Hollywood Studios Expansion/Refurbishment.. We all know that it is in dire needs of a facelift and Disney has answered the question on the Disney Parks Blog of when is this going to happen with basically a “Stay tuned for more information.” What this means is it must be coming and soon because they did not say no and they did not ignore the question. Just like when your parents say maybe it always means yes…same thing I think.

Lastly, there are some new stage shows coming to WDW supposedly…who, when, why and how have not been answered but I for one love the stage shows. I love Nemo and The Lion King at Animal Kingdom and Beauty and the Beast in Hollywood Studios, and so more shows means more entertainment for moi. I will say this watching Chip trying to walk, take pictures and eat a cupcake while at WDW is pretty entertaining but I want MORE! How about you?

Mermaids now appearing on Pirates of the Caribbean at Walt Disney World Resort

The Mermaids of Whitecap Bay, recently made their debut at the Pirates of the Caribbean attraction. You can spot them early on in the attraction’s grotto scene, where you can spy a mermaid skeleton and possibly even catch them swimming alongside your boat. You can also hear a mermaid beckon you with her siren song just before your drop into the pirate battle. Additional rockwork and props have also been added into the Dead Man’s Cove scene.

This isn’t the first time something from the “Pirates of the Caribbean” film franchise has debuted at the Pirates of the Caribbean attraction. Famous faces from the film, including Captain Jack Sparrow, Captain Barbossa, and most recently the ghostly apparitions of knaves Davy Jones and Blackbeard, have all materialized over the years.
