Woman Sues Disney After ECV Accident in Little Mermaid Queue at Magic Kingdom
A Florida couple is suing Disney after an alleged accident in the queue for Under the Sea – Journey of The Little Mermaid at Magic Kingdom left a woman with serious injuries. According to the lawsuit, Deborah Montgomery was using an Electric Conveyance Vehicle, or ECV, while visiting Walt Disney World on August 7, 2024, when her foot became wedged between the vehicle and part of the attraction’s cave-like queue.

The complaint alleges that Montgomery’s foot became caught in a narrowing crevice along the wall as the ECV continued moving forward. The lawsuit claims she suffered injuries to her foot, ankle, and leg, including a fractured fibula, as well as ongoing medical complications. It further alleges that Disney failed to provide a reasonably safe path through the queue, adequately inspect the area, provide sufficient warnings, and maintain proper lighting.
Montgomery’s husband, Matthew Montgomery, is also named as a plaintiff in the case. His claims include loss of companionship, sleep, and income related to helping care for his wife and transporting her to medical appointments. The couple is seeking $50,000 in damages.
