Parents of 9-year-old killed by bus say Disney bus driver was at fault

The parents of the boy killed by a Disney bus Thursday say Walt Disney World is to blame for the accident.

Chase Brubaker, 9, of Redington Beach, was riding his bicycle with a friend Thursday when he was killed by the bus on the park’s camping grounds, according to a Florida Highway Patrol report. But the boy’s mother, said the 11-year-old friend swore Chase was cautious and never left the sidewalk.

“The first thing she said was, ‘Kelly, we were on the sidewalk,'” Kelly Brubaker said outside her home Friday morning. “He did not run into that bus.”

Brubaker pointed to the boy’s little blue bike, which she and her husband brought home. It appeared to be in good condition, with only the right brake bent.

The Florida Highway Patrol said the children and the bus were southbound on Big Bend Drive in the Fort Wilderness Resort area when Brubaker apparently tried to look back, then drifted off the sidewalk and hit the middle of the bus.

He was knocked off his bike and pulled under the right rear tire, troopers said.

Florida Highway Patrol’s Sgt. Kim Montes said she understands the family’s grief, being a mother herself. The investigation is ongoing, but based on what she knew, she did not believe the bus veered into the boy.

“If we didn’t have the physical evidence or witness statements that we had, we wouldn’t make such a statement,” she said.

Both Brubaker and the 11-year-old girl were wearing helmets. She was uninjured. There were 28 people on the bus.

Bus driver David Rich, 56, has worked for Disney for 30 years. Charges are pending, Montes said, but pending charges are typically routine in fatal accidents.

Disneyland Resort Paris reels after double suicide

A Disneyland kitchen chef in his 40s hanged himself at his home in Marne-la-Vallee near Paris last Friday, in an incident which the Disneyland division of French union Force Ouvriere (FO) believed was associated with poor working conditions,  it emerged today

It followed the death of a 30-year-old employee at the park, also a chef, who threw himself in front of a train on February 21.

FO said the staffer was forced to work in “humiliating” conditions after returning to the resort from a period of sick leave.

A day before his suicide, another 22-year-old worker threatened to kill himself in the attraction park after the announcement of his dismissal.

In a statement, FO slammed “the working conditions and the pressure put on the employees within the business” of Disneyland Paris.

“In this difficult situation, the union requires Eurodisney … to begin a health and safety inquiry, to communicate to and listen to its employees,” it said.

Questioned by AFP, FO representative Mary Lyn Lesueur admitted that the union had yet to establish a concrete link between the latest employee suicide and work conditions, acknowledging that personal problems also contributed to his death.

“But it is certain that there is a real problem of management at Disney,” she added.

Work-related deaths became a big issue in France last year after it was revealed that France Telecom had been plagued by a spate of suicides.

At least 44 members of staff killed themselves at the company since 2008, in a phenomenon unions blamed on harsh management culture.

“This afternoon, we experienced a tragic accident on our property.

We are deeply saddened by what happened and are doing everything we can to provide resources and support to the family. The circumstances of the accident are under investigation by the Florida Highway Patrol and we are working closely with them to gather the facts.

Our hearts and prayers go out to the family, and all of our Cast Members join me in extending our deepest sympathies.”

Despite being one of the most popular tourist destinations in the world with millions of visitors every year, Disney World has had a very low number of serious accidents and fatalities on site. 

Aug. 22, 1989: A 29-year-old jogger was seriously injured on Walt Disney World property when he ran in front of a truck.

Feb. 8, 1990: A worker was killed at Disney Hollywood Studios when he fell 33 feet to his death from a scaffold while working on an air-conditioning duct.

Feb. 8, 1990: In an unrelated accident, three tourists were injured when three sets of cars in the Space Mountain roller coaster at Walt Disney World’s Disney World Magic Kingdom abruptly stopped because the computer detected a faulty wheel and automatically halted the system.

Feb. 6, 1990: Five tourists suffered minor injuries when pieces of molding fell from the ceiling of the Haunted Mansion attraction at Walt Disney World’s Disney World Magic Kingdom.

Aug. 18, 1994: A 6-year-old girl was badly injured when she became pinned between a boat and boarding dock at the It’s a Small World ride at Walt Disney World’s Magic Kingdom. The girl suffered collapsed lungs, a broken rib and a broken arm.

Dec. 31, 1999: Six people were burned when fireworks at Disney World’s New Year’s Eve festivities exploded near them.

June 13, 2005: A 4-year-old boy died of a heart attack after riding the Mission: Space ride at Epcot.

April 11, 2006: A 49-year-old woman became ill after riding Mission: Space at Walt Disney World’s Epcot. She was taken to a nearby hospital and died the next day.

Dec. 18, 2007: A 44-year-old man visiting Walt Disney World died after apparently suffering a heart attack on the Expedition Everest roller coaster in Animal Kingdom. No heart defibrillators were immediately available in the area.

July 5, 2009: A 21-year-old monorail driver was killed when his train crashed into another monorail because of a track change malfunction. This was the first fatal accident involving a monorail in the resort’s 38-year history.

Aug. 6, 2009: A 47-year-old Disney performer was injured during Captain Jack’s Pirate Tutorial show at Disney World. He succumbed to his injuries and died a few days later.

Aug. 17, 2009: A stuntman at Disney’s Hollywood Studios died after suffering a head injury while practicing a tumbling roll during a rehearsal for the Indiana Jones Epic Stunt Spectacular show.

Oct. 31, 2009: A 4-year-old girl was injured at Disney’s Fort Wilderness resort when a golf cart she was riding in overturned.

March 14, 2010: A Walt Disney World employee broke his leg after he was struck by a guest driving a car at the Tomorrowland Speedway in the Magic Kingdom.

March 23, 2010: Eight people were injured, one seriously, because of a crash between a Disney bus and Waldorf-Astoria bus near Epcot.

April 1, 2010: A 10-year-old boy was hit and killed by a bus while riding his bike at Disney’s Fort Wilderness.

Does your little girl love the Disney princesses?  Or is she more into the fairies and the Pixie Hollow scene?  If so, she is in luck.  Disney has a line of cuddly friends just for girls!

These bears were designed by Disney for the Animal Alley collection which is a mark of Geoffrey, Inc. (a subsidiary of Toys “R” Us, Inc.).  They stand about 18″ tall and are super cute and cuddly soft.  Not to mention, fabulously decked out in the style of your favorite Disney princess or Tinkerbell.  The bears are well made and do not include any beans.  A recommended age was not specified.

We are planning a one day trip to Disney World in June. We got a deal on the Contemporary Resort, 40% discount per night. We WANT that same discount on a Bay Lake Villa resort with 2 bedrooms, but they say there aren’t any rooms available with that discount. You know anything about how to get one? Times to call??

Meg:  Thanks for reading the site and for your question. Sadly, there’s no real trick to getting these deals other than to know that they’re out there and to ask for them.  It also helps to have flexible travel dates.  Disney only sets a aside a small number of rooms under these codes based on sophisticated projections of what they need, what they already have, and what they can expect to book without incentives in the upcoming months.   They fill up quickly and once they’re gone, they’re gone.

There are a couple of things you can try.  As much as I love planning my own trips, I’ve gotten better deals with a Disney authorized travel agent.   They don’t charge for their services and are really good about finding the best rates, so if they can’t find something that works for you, all you’ve lost is the amount of time it takes to contact your agent and explain your needs.  We don’t specifically recommend anyone on this site, but if you want to know who I use and who I recommend to my friends, send me an email and I’ll give you her information.

Second, and I think this is probably your best bet at this point, consider renting Disney Vacation  Club (DVC) points.  You can rent points from individual owners on  the DVC forum of Disboards or on Mouseowners.  Both forums will require you to register to post. Mouseowners has a particularly good section on the dos and don’t s of renting points.  The Dis, which is the more active board, only allows renters to respond to owners’  listings but is pretty flexible beyond that.  Make sure you get references from the owner and be wary of renting from someone with a low post count.  Most points rent for around $10, but more desirable resorts like BLT may go higher.  Sometimes on Mouseowners, owners rent out confirmed reservations. These tend to be pretty good deals and are worth a look.  Quite often the owner will allow you to rent  a day or two rather than the entire reservation.

If the idea of renting from an individual owner sounds too risky, consider renting from a points broker like DVC by Request. They charge around $13 a point but are usually pretty successful at matching up owners and renters. Since they act as an intermediary  between you and the owner,  you won’t have contact with the owner, so this makes the whole process easier on you.  Keep in mind that both brokers and owners and have very strict cancellation policies (as in, you’re out of luck), so trip insurance is a good idea.

I went to the Disney site and looked for a 2-bedroom Bay Lake view at BLT for a weeknight in June (the 15th, if you’re counting) and put in the numbers and it came out at a whopping $979!  But hey, that includes tax.  I then went over to Mouseowners, checked the points charts, and found that this same night “rented” for 48 points a night.  Even renting from a broker and paying the absolute maximum of $13 a point, you’re still only paying about $624.   It’s not as good as 40% off, but it’s close.

Depending on how important it is to stay in BLT, I would look around and see what I could find. It’s a beautiful resort. But don’t cancel that Contemporary reservation just yet.  Good luck. And please let us know if you find a good deal!

Zappos.com Sues the Walt Disney Co

Zappos.com, Inc. has filed a class action lawsuit against the Walt Disney Company over false advertising. Tony Hsieh, CEO of Zappos, says it’s just one battle in his efforts to prevent companies from making misleading claims.

The lawsuit alleges that Disneyland’s tagline of being “The Happiest Place on Earth” is “clearly false, deceptive, and confusing to the marketplace”,and cites internal Net Promoter Score (NPS) metrics that suggest that the designation should be given to Zappos.com, Inc.

A legal representative from Zappos declined to comment, citing company policy on pending litigation. Representatives from Disney did not immediately return phone calls seeking comment.

A local Las Vegas news station uncovered additional details immediately after the actual filing of the lawsuit.
