Guest Permanently Drops Main Street Trolley Lawsuit Against Disney World

If you have ever taken a stroll down Main Street, U.S.A., in the Magic Kingdom at Disney World, you know there is a lot to take in. Between the towering sight of Cinderella Castle, the sweet aroma of confectionery treats, and the bustling crowds, it is easy to get a little distracted. However, a legal battle centered on one of Main Street’s most iconic—and easily overlooked—features has officially come to an end.

A guest who filed a $50,000 lawsuit against Walt Disney Parks and Resorts after tripping and falling over the Magic Kingdom trolley tracks has officially dropped her case.

The legal saga began following an incident on October 24, 2025. According to the initial lawsuit filed in December 2025 by a Kentucky resident, the guest was walking near the hub by Cinderella Castle around 5:00 PM when her foot caught on the embedded steel rails and flangeways of the trolley track.

The fall allegedly resulted in permanent injuries, significant medical expenses exceeding $20,000, lost wages, and physical and mental pain.

In the complaint, the plaintiff argued that Disney failed to maintain a safe environment for guests. The suit claimed that the embedded tracks created hazardous gaps and changes in elevation. Furthermore, it argued that Disney did not provide adequate warnings, guardrails, cones, or stanchions to protect guests from these tripping hazards—especially during high-traffic times like parade operations and nighttime crowd conditions.

Disney’s legal team was quick to fire back, denying all liability and shifting the responsibility back to the guest.

In their formal response filed in early 2026, Disney argued that the trolley tracks are an “open and obvious” feature of Main Street, U.S.A.—a design that has safely existed in Disney parks for decades. Disney’s attorneys asserted that:

  • The guest owed a duty to use reasonable care for her own safety.
  • She breached that duty by failing to pay adequate attention to her surroundings.
  • Because the tracks are plainly visible, Disney was under no obligation to provide extra warning signs, cones, or barriers.

Disney also raised Florida’s modified comparative negligence rule. Under this law, if a jury determines a plaintiff is more than 50% at fault for their own injury, they are barred from recovering any damages. Backed by this defense, Disney demanded a trial by jury.

Court Rules in Favor of Disney in Viral Magic Kingdom Brawl Lawsuit

Instead of heading to the courtroom for a trial, which had been scheduled for late 2027, the plaintiff decided to walk away.

Court records show that the plaintiff submitted a Court Notice of Voluntary Dismissal with Prejudice. Filing “with prejudice” is a major win for Disney’s legal team, as it means the lawsuit is permanently dismissed and the plaintiff is legally barred from ever filing the same claim again.

While millions of guests successfully navigate the charming brick streets of the Magic Kingdom every year, the trolley tracks remain a famous hazard for distracted walkers. This voluntary dismissal serves as a quiet reminder to keep one eye on the beautiful sights of Main Street, U.S.A., and the other eye on the ground!
