Michigan pair win rainy, cold Disney Half Marathon

Chad Johnson and Emily Mortensen, both of Rochester Hills, Mich., were the top men’s and women’s finishers in the Disney Half Marathon this morning.

The 13.1-mile race, which began and ended at Epcot, featured almost 23,000 runners who competed despite rain, sleet and flurries and temperatures in the low 30s.

Johnson won the half marathon for the second time, finishing in 1 hour, 7 minutes, 2 seconds to edge his Michigan running-club teammate, Sage Canaday, by 18 seconds.

Hunter Kemper of Longwood was fourth in 1:09:12.

Mortensen (1:20:58) won by almost a minute over Elizabeth Foster (1:21:52) of Ellington, Conn.

The weekend’s marquee event, the Disney Marathon, is set for tomorrow morning, which may see a record low cold temperature. The National Weather Service has issued a wind chill warning from 9 tonight to 10 a.m. Sunday. A wind chill warning means a combination of very strong winds and cold temperatures will create “dangerously” low wind chill values.

Disney Marvel Sues for Mutant Rights

You kinda figured this was coming with Disney’s buyout of Marvel. Seems Marvel is suing to keep the rights to Spider-Man, the Fantastic Four and X-Men—from the heirs of artist Jack Kirby.

A federal lawsuit filed Friday in Manhattan asks a judge to invalidate notices sent by the heirs to terminate Marvel’s copyrights.

Here is the official announcement:

Subsidiaries of Marvel Entertainment, LLC today filed suit in federal court in Manhattan seeking a declaration that notices of termination of copyright assignments served by the heirs of long-time Marvel artist Jack Kirby are invalid.

Last September, attorneys acting for the Kirby heirs sent 45 notices to Marvel seeking to terminate purported assignments by Kirby of copyright interests in Marvel Super Hero characters such as X-Men and Fantastic Four. Kirby’s heirs are claiming that from 2014 to 2019 various rights supposedly transferred to Marvel will revert to them. The Marvel lawsuit asserts that those claims are baseless because all of Kirby’s contributions to Marvel’s publications, like those of other comic book writers and artists of the same period, were works made for hire, making Marvel the sole owner of the copyrights.

“The notices filed by the heirs are an attempt to rewrite the history of Kirby’s relationship with Marvel,” said John Turitzin, Marvel’s General Counsel. “Everything about Kirby’s relationship with Marvel shows that his contributions were works made for hire and that all the copyright interests in them belong to Marvel.”

Under federal copyright law, works that were created at the “instance and expense” of a publisher during the time Kirby was a creator for Marvel were “works made for hire” and owned by that publisher. If, for example, Marvel gave a writer or artist an assignment to create a comic book story populated with new characters or to illustrate a comic book story with depictions of its characters – and paid the writer or artist for carrying out the assignment – the publisher, not the writer or artist, would own the copyright. All of Kirby’s contributions to Marvel comic books the heirs are claiming for themselves fall into this category.

Marvel editors determined which publications Kirby would work on, just as they did with all the other artists and writers engaged to work on the publications, and always retained full editorial control. In addition, Kirby was paid for his contributions. As a result, all of Kirby’s contributions were solely owned by Marvel, which was standard practice in the comic book publishing industry.

Kirby’s situation at Marvel is completely different from the facts that gave rise to the Superman litigation. The initial Superman story was written and illustrated by its creators well before they had any business relationship with its ultimate publisher.

“The purpose of the lawsuit filed today is simply to set the record straight and obtain a judicial declaration that the Kirby termination notices have no effect,” said Mr. Turitzin.

If you want to be the first to see Kermit the Frog and Miss Piggy in a parade at Disneyland park, check out the video above. We taped this during a rehearsal after Disneyland park closed on Wednesday night. The video gives a first glimpse of the new Disney’s Honorary VoluntEars Cavalcade that will debut today at both Disneyland park in California and Magic Kingdom park in Florida.

As youll see, the cavalcade celebrates volunteerism and features Kermit, Miss Piggy, along with special floats and vehicles festooned with bright balloons and flanked by parade dancers. Theyre all excited about the new Give a Day, Get a Disney Day program happening in 2010 (see www.disneyparks.com for terms).

Disney’s Honorary VoluntEars Cavalcade precedes Celebrate! A Street Party at Disneyland park. You can catch the show at Disneyland park once a day, and there are a few things you should know about the current schedule:

  • If there is only one performance of Celebrate! A Street Party scheduled for the day, then the cavalcade will happen at that time.
  • If there are two performances of Celebrate! A Street Party planned for the day, then you can catch Kermit and Miss Piggy as part of the Cavalcade at the evening parade.

As always, check for show times because theyre subject to change and cancellation.

Watch out Disney Parks here comes the Muppets!

This is some great news having grown up on the Muppets I am real excited to see them get more face time at Disney other than MuppetVision 3D. When the Give a Day get a Day promotion was being introduced by Kermit and the gang it was like seeing old friends.

Here is some of the article from Kristin Ford at the Daily Disney:

Disney has been re-introducing the Muppets by linking them to causes that today’s youth care about, such as the environment and volunteering. Who’s more green than Kermit, right?More merchandise is showing up in stores, including Once Upon A Toy Store at Downtown Disney. We noticed quite a lot displayed up front by the registers when we were shopping during Christmas week.

And now visitors will be able to see the characters in the Disney parks. Beginning Friday (Jan. 8), each afternoon Kermit, Miss Piggy and Sweetums will be part of a pre-parade celebration at Disney World’s Magic Kingdom and at Disneyland in California. Muppets characters and parade dancers will join special floats and vehicles celebrating volunteerism and presenting honorary VoluntEARS as grand marshals of the parades. Can meet-and-greets be far behind?

World of Color — Behind the H2O — The Journey Begins

As testing begins in the Paradise Bay Lagoon, through periodic blog posts, we’re going to be giving guests a behind the “water screen” look at the show as it is created. It will take months of programming to bring all the elements to life as we weave the tapestry of the show together. When you create a show you mentally put it together in your mind. Then you take those initial ideas and test them looking for the right look and feel. After a lot of trial and error, you finally get to see it come to life in front of your eyes.

But even before the programming sessions can begin, all the effects systems have to be brought on-line and fleshed out. With thousands of individual effects in the show, this meticulous initial testing process takes time. Every device has to be individually tested and programmed into the master show matrix. Once this is complete, the actual programming can begin.

One of the first effects elements to be tested was the fire system. Audiences are going to be really surprised by the World of Color fire effects. Because the units are randomly placed throughout the show platform, they will shock you when they appear. Here is a test video of the first look at the fire. While it is not the final program, it will give you a sense of the visual power it yields!

Disney may distribute tickets for 'World of Color' water show

Suzi Brown, a Disneyland Resort spokeswoman, said Disney officials already predict the show will be “extremely popular,” so they are considering various ways to address crowding.

A ticket program is “one of many different options being explored,” she said.

World of Color will feature images of Disney cartoons projected on a 19,000-square-foot water screen and fountains that squirt up to 200 feet from Paradise Bay.

The debut of a new light-and-water show at Disney’s California Adventure is scheduled for later this spring, but Disney is already trying to figure out how it will deal with expected massive crowds.

One idea is to distribute tickets for entrance to a 9,000-person viewing area to see World of Color.

So if you have been following the Disney/Marvel News Thor is getting moved up and Spiderman will probably be later in the year. Either way I know Disney/Marvel will be getting alot of my box office dollars in 2011.

Tobey talks with reporters from ABC about Spider-Man 4 preproduction snags:

Tobey Maguire doesn’t think “Spider-Man 4” has become a tangled mess.

The 34-year-old star of the web-slinging superhero franchise said preproduction snags aren’t dampening his mood about the fourth installment. The next “Spider-Man” film had been scheduled to swing into theaters May 6, 2011, but that seems unlikely now that “Thor,” another big-screen Marvel superhero adaptation, has hammered out the same release date.

“Like anything, it’s a process,” Maguire said Thursday. “We’re just in the midst of the process. We have a lot of great stuff in terms of story and script. We’re just trying to dial it in and get it ready as quickly as possible. Of course, these movies are a very big undertaking and take a lot more time than a drama or something more straightforward.”

Disney’s official fan community, D23, is starting off 2010 with a unique gift that’s sure to get any Disney fan excited — Disney Undiscovered: A 23-Month Calendar of Disney’s Unrealized Masterpieces.

The calendar is brimming with rare and never-before seen images from Disney theme-park, live-action and animation projects that were not completed, many of which have achieved legendary status among Disney fans. “Disney Undiscovered” features art from never-built project like the Mineral King ski resort and Walt Disney’s St. Louis Project, theme park lands such as Discovery Bay at Disneyland, and unproduced films including a watercolor from the original Little Mermaid that Walt had in early preproduction in the late 1930s.

I have said this before and I will say it again if you are not buying your tickets from an Authorized Disney Ticket Agent you are probably going to get burned..

Arizona Department of Public Safety Detectives have identified 30 victims so far who have purchased fraudulent amusement park passes from a Craig’s List scammer. Following a two- month investigation DPS detectives assigned to financial crimes arrested a Phoenix area man for selling fraudulent passes to unsuspecting buyers. The suspect advertised the tickets and passes on Craig’s List and would meet the victims in person to sell groups of unvalidated passes stolen from area retailers for hundreds of dollars. Many of the victims and their families made the trip to southern California only to find out that the passes were of no value.

Angered and frustrated, victims contacted DPS detectives, who began a thorough investigation, which led to last week’s arrest.The suspect was booked into the Fourth Avenue Jail on charges of Fraudulent Schemes, a class-two felony. DPS is withholding the suspect’s photo so that other potential victims can have the opportunity to identify him through a photo line up.

Additionally, the suspect was not working alone. Victims were also sold passes from a female and others may be involved as well. DPS detectives said they believe the suspect and his counterparts have been selling fraudulent passes for at least three months.

Potential victims with any information are encouraged to call the DPS Duty Office at 602-223-2212, and ask to be forwarded to the Financial Crimes Unit. DPS would also like to alert citizens of frauds such as these and to check with a trusted retailer before purchasing items from an individual, or in other words “Buyer Beware.”

If a deal appears too good to be true, then it probably is.

Here is a great Disney deal worth noting for Disney Passholders.

Passholders, here’s a pretty sweet deal if you’re into NASCAR. Stop by Walt Disney World Speedway — it’s situated right in front of Magic Kingdom — and you can do a Ride Along from Richard Petty Driving Experience for free. This program normally costs more than $100 per person.

Show your Disney pass and you’ll get to ride shotgun for three mile-long laps in a NASCAR-style race car reaching speeds up to 140 mph with a professional driving instructor. This offer is good through March 31.

You must be at least 14 years old to ride, and participants younger than 18 must be accompanied by a parent or legal guardian. Free ride-alongs are limited to one per passholder for the three-month promotion.

While at the track, passholders can enter to win an 18-lap King’s Driving Experience valued at $919.04 and Richard Petty-signed diecast car.
