Disney is threatening Brightspark Productions with legal action due to its movie titled “Braver” based on the title and packaging being too closely related to Disney’s animated film, “Brave”. According to Brightspark, “Braver” was released initially in 2005 under the name, “A Fairy Tale Christmas” and the Brighton, England based company claims was for “families on a budget”.
“Brave”, voiced by stars such as Billy Connolly and Emma Thompson, was released this past Summer and has quickly gained blockbuster status for Disney.
‘People place great trust in the quality and creativity of Disney and, when it appears that another company is causing confusion, we will act to protect ourselves and the consumer,’ Walt Disney Company’s European senior vice-president Peter Wiley said.
This is not the first time Brightspark has been on Disney’s radar for a similar legal issue. Disney has also criticized Brightspark about the title change of Brightspark’s DVD formerly titled “Fairy Tales From Around the World” which has been changed to “Tangled Up” and has a similar cover to Disney’s “Tangled”.
On LoveFilm.com, an Amazon company, “Braver” is described as “A beautiful princess is kidnapped from the castle and her father the king. She must battle adversity and find the courage within to discover her true destiny.”
Brightspark disagrees with Disney’s assessment and states, “I very much doubt that anyone would confuse our production with the wonderful work of Disney,” said Brightspark Production’s managing director Jeremy Davis. “If we thought consumers would mistake our film for Brave, we would have renamed it,” continues Davis.
Davis feels confident that this can be resolved easily stating that the two companies would hold talks to come to a “mutually acceptable solution”.

wow I cant believe that Brightstart thinks they can go up against Disney!
If anything Disney are letting this bunch off lightly.
The real people being harmed by this though are the original makers of `A Fairy Tale Christmas` since its their film thats being passed of as something different from what they intended.

I think they’re changing the names of their films so they can capitalize off of Disney, regardless of whether or not the stories are similar.
