The Walt Disney Company is being accused of using “Hollywood accounting” to cheat the creators of the popular 90’s show “Home Improvement” out of their share of profits.
In the lawsuit, Matt Williams, Carmen Finestra, David McFadzean, and Wind Dancer Productions are accusing Walt Disney Pictures of using some accounting tricks to avoid paying them their fair share of the profits.
The creators behind the show say they should have received 75 % of the profits from the series. This contract is dated back to the 90’s.
According to the court papers filed, it is said that Disney worked their way around their end of the bargain by charging expenses and distribution fees to the series and not reporting cable retransmission royalties, merchandising, and music publishing revenue.
The plaintiffs claim Disney refused to give auditors all the records they need. The creators claim they have been able to complete only 3 out of 6 audits, during the shows run in the ’90s. They are saying that a full audit from 2001 to 2012 is still not completed.
The complaint says that Disney has made a killing on this show due to their continued exploitation of the show.
According to the 20 page document filed, Disney reportedly told the creators they have to “‘wait in a queue'” with other people that are to share profits in the series as well. The creators say they have been made to wait around for more than 4 years for a full audit.
Even though they don’t have all the information, the creators say that the audit reports show that Disney failed to properly account for revenue from the show, which is still sold into syndication and has made more than $1.5 billion in profits.
The plaintiffs are seeking an accounting, which is their rights under the agreements, and damages.
