Kelly Brubaker, mother of Chase Brubaker, a 9-year-old boy who was accidentally hit and killed in April 2010, by a Walt Disney World bus has settled her lawsuit with The Walt Disney World Company. Brubaker, who filed an auto-negligence lawsuit against Disney and the bus driver back in October 2010, settled last month for undisclosed terms, a spokeswoman announced.
Chase Brubaker, a Redington Beach residence, was at Disney’s Fort Wilderness Resort on April 1, 2010, with his family when tragedy struck. Chase and another child were riding bicycles on the sidewalk, when Chase veered off the sidewalk and into the oncoming bus. Chase fell off his bike at the time and was run over by the rear right tire said the Florida Highway Patrol.
Disney spokeswoman Andrea Finger would not disclose details of the settlement. “The case has been settled to the parties’ satisfaction,” she said.
Kelly Brubaker and Chase’s family has insisted that the accident was the fault of Disney and the bus driver, who had over 30 years experience with Disney.
