Disney World Files Motion to Dismiss Annual Passholder Lawsuits
Disney is fighting back against a lawsuit that is in the courts by Palm Beach County resident Erica Kelly and Orange County resident Marilyn Paone who are suing them over the Disney World Reservation system specifically Disney changing the terms for Annual Passes.
According to Flordia Politics, “Changing the terms of their annual passes’ park access due to a pandemic, after expressly reserving the right to do so, is not plausible bad faith, injustice or an unfair business practice.”

The initial lawsuit by the Annual Passholders was filed back in October 2022 and states “Disney’s conduct is a predatory business practice, aimed at exploiting the customers who support it the most, its annual pass holders. Disney abused a global pandemic to take advantage of its own loyal customers and increase its revenue.”
The Annual Passholder Reservation still remains in place as Disney seeks to dismiss the lawsuit. According to Disney, “Kelly and Paone omitted from their complaint everything that Walt Disney Parks and Resorts did for annual pass holders during the transition to the reservation system — including, most notably, giving every pass holder the chance to opt-out and be refunded,” Disney said in court documents, noting the two women chose to continue on with their Annual Passes.
I guess we will have to wait and see if Disney is able to get the Annual Passholder Lawsuits Dismissed.
