A Brevard County Jury recently ruled that Disney Cruise Line is responsible for paying $4 million to Maria Ana Reis Martins, a former dining room server on the Disney Dream cruise ship.
According to the Miami Herald, Martins was working for Disney Cruise Line in 2013 when she was hit by a car in Nassau, Bahamas while on shore. The ship’s medical team did not find any severe injuries and approved her to continue work. It wasn’t until 10 days later when health issues started to pop up.
Martins eventually saw a doctor in Florida and found out that she had, indeed, broken three ribs and had to go home to Portugal for five months to receive the medical care she needed. Flash forward to a couple years later (2015) and Martins decides to go back to working for the Disney Cruise Line. She only makes it a month, however, before experiencing more pain in her ribs.
One trip back to her doctors in Portugal revealed that she was suffering from nerve damage. After finding this out, she decided to sue Disney Cruise Line in December 2015.
Finally, the case was brought to a Brevard County Jury (under Disney Cruise Line conditions) earlier this month. Martins’ attorney argued that Disney Cruise Line “failed to provide adequate medical care” to their client, while Disney Cruise Line refuted that “it had fulfilled its duties of care under maritime law.”
On Dec. 19, 2019 Disney Cruise Line had lost the case and is required to pay $1 million for pain and suffering, $2 million for lost earnings, and $1 million as punishment to Maria Ana Reis Martins.
