You may have heard about the legal brawl going on between Deadmau5 and Disney. Disney is suing Deadmau5  because his logo is to close to their mouse ears logo. So they are trying to block him for getting a trademark for his logo in this country. Keep in mind that Deadmau5 has been around for about 10 years and Disney has not had an issue with it until now.

Deadmau5 already has his logo tradmarked in 30 other countries.

Deadmau5 doesn’t seem to be bothered by the suit he reportedly said he won’t be bullied and is ready to fight.

  1. Deerhart, I don’t know the full story but by going off of this article it doesn’t say that he has had the copyright for 10 years in other countries. It says he has been around for 10 years (assumingly using this logo)

    Now Lets say he has used it from the start. Depending on his popularity, if he didn’t become popular until recent it is possible that Disney may have been unaware of his (and the logo’s) presence. This would be the same with any person. business or other entity. If this is the case he will have an uphill battle ahead of him. I am not a judge of music ratings and popularity but personally I hadn’t heard of Deadmau5 until early last year.

    Now one thing that makes this story interesting and this blog post doesn’t report is the Disney reMics they made using Deadmau5’s song “Ghost’s and Stuff”. His lawyer sent Disney a cease and desist order to which Disney reponded “The music was appropriately licensed, and there is no merit to his statement.” From reading other articles it also says he originally applied for his trademark in the US in 2013. It appears that it was at this point that Disney became aware or at least is when they became interested in blocking the trademark.

    With that said, I think he is going to have an uphill battle

  2. I’m for whoever is standing by the law. If it’s being violated then then I’m with Disney, but if not, then Deadmou5 deserves it.

  3. Copyright and trademark laws vary drastically from country to country. The fact that Disney has not done anything in other countries over the last 10 years may speak more to how those countries treat copyright and trademarks then it does about Disney being okay with the logo.

    The US tends to have more protective laws then other countries and Disney probably believes it will be more successful fighting it here then in the other countries.
