An Indiana woman has filed a negligence lawsuit against a Walt Disney World Resort.
Kathleen Vibbert of Logansport, Indiana filed a complaint against Walt Disney Parks and Resorts U.S. Inc. in the Orange County Circuit Court on January 8th. She is alleging that the defendant failed to exercise reasonable care for the safety of guests.
The suit claims that on January 5th Vibbert visited Columbia Harbor House at Magic Kingdom Park. While there, she slipped and fell as a result of liquid and ice on the floor near the entryway.
As a direct result of that fall, Vibbert sustained bodily injury that resulted in pain, suffering and an expensive hospitalization according to the suit.
The lawsuit claims the Walt Disney World Resort failed to maintain, or adequately maintain, the entrance area of the restaurant when ice and liquid were allowed to remain where guests had to walk. This created a condition that was hazardous to the public using that entryway floor.
The plaintiff is seeking damages of excess of $15,000, plus interest and court costs in a trial by jury. Vibbert is being represented by attorney James T. Lynch of Morgan & Morgan, PA in Orlando in court case 18CA000223 in the Orange County Circuit Court.
