Family of Boy Killed in Bus Mishap Settles Lawsuit with Disney

Kelly Brubaker, mother of Chase Brubaker, a 9-year-old boy who was accidentally hit and killed in April 2010, by a Walt Disney World bus has settled her lawsuit with The Walt Disney World Company.  Brubaker, who filed an auto-negligence lawsuit against Disney and the bus driver back in October 2010, settled last month for undisclosed terms, a spokeswoman announced.

Chase Brubaker, a Redington Beach residence, was at Disney’s Fort Wilderness Resort on April 1, 2010, with his family when tragedy struck. Chase and another child were riding bicycles on the sidewalk, when Chase veered off the sidewalk and into the oncoming bus. Chase fell off his bike at the time and was run over by the rear right tire said the Florida Highway Patrol.

Disney spokeswoman Andrea Finger would not disclose details of the settlement. “The case has been settled to the parties’ satisfaction,” she said.

Kelly Brubaker and Chase’s family has insisted that the accident was the fault of Disney and the bus driver, who had over 30 years experience with Disney.

  1. An unfortuante accident occured. It was not the fault of the bus driver, the bus or Disney. I am at a loss as to why the Disney Company did not fight this case. I could not fathom what these parents are going through, but to put the blame on a blameless accident is aweful. And to take a “settlement” is a little creepy. No amount of anything could ever replace the life of a child.

  2. I also agree. And according to the article it says that he was hit by the REAR tire and not in front of the bus. So how was the driver supposed to see the boy coming. Disney should have fought this one!

  3. I couldn’t agree with you more. This was just a tragic ACCIDENT. I can’t believe the family wouldn’t see that. The bus did not go onto the sidewalk the child fell off the sidewalk into the path of the oncoming bus. What was the driver to do? Magically fly up to not strike the boy.

So sorry for there loss but it was an accident..I can’t see how it was Disneys or the drivers falt..the poor child fell in front of the on coming bus…My grandson was hit several years ago not hurt to bad but it was his falt he went in front of the MOVING bus…My daughter to her credit refused Disneys offer to pay for everything because she new it wasn’t there falt…She told them if she hadn’t taking her eyes off the child it would not have happened…She took responsibility for what happened and didn’t expect anyone to pay for there mistakes…
