Disney recently won a civil federal lawsuit against Mouseprint Media, a Winter Garden online retailer. The lawsuit was for copyright and trademark infringement for using images from Star Wars, Frozen, Mickey Mouse, and more on shirts.
The court order outlined steps that Mouseprint Media, also known as DisGear, agreed to in order to essentially shut down its business. It also relinquished its merchandise and website to Disney’s control. The unsold merchandise will be given to Disney to be destroyed and the websites will be shut down.
Disney and Mouseprint Media are not connected and Disney argued that the public would be confused into believing they are. The lawsuit said, “Adding to the likelihood of confusion, Defendants have reproduced photographs of various Walt Disney World Resort rides and attractions in their marketing materials.”
Mouseprint Media also agreed to abandon its Patent and Trademark applications and not file any new ones. The lawsuit said Disney was unsuccessful at contacting the store to ask them to stop selling their merchandise before legal action was taken. Disney is known for being fierce in protecting its intellectual property.
The court order stated that Disney “will continue to suffer irreparable harm and injury should this Court not issue a permanent injunction enjoying such actions by the Defendants.”
