Years of court battles have finally come to a close after a lawsuit, filed by former Disney employees, was dropped. The group of former IT employees filed a discrimination case against Disney, claiming that they were unlawfully fired and replaced with overseas employees. They also claimed that they had to train the new employees, who were in the US on work visas, for 90 days prior to their firing.
The lawsuit was dropped after the lawyer for the former employees, Sara Blackwell, acknowledged that the claim was a legal loophole and could not be won. “We lost because what Disney did was legal,” she said. Blackwell filed numerous lawsuits against Disney since 2014 regarding the discrimination of the former employees but lost all of them.
The program in question is the H-1B Program, allowing non immigrant aliens to to come to the US and work in specialty occupations. According to the United States Department of Labor, “A specialty occupation is one that requires the application of a body of highly specialized knowledge and the attainment of at least a bachelor’s degree or its equivalent. The intent of the H-1B provisions is to help employers who cannot otherwise obtain needed business skills and abilities from the U.S. workforce by authorizing the temporary employment of qualified individuals who are not otherwise authorized to work in the United States.” Companies all across the US are using this program to help staff their businesses.
Sara Blackwell and the former employees are continuing their fight by demanding reform of the H-1B Visa program.
Disney responded to the dropped lawsuit by stating, “As we have said all along, these lawsuits were completely baseless.”
